These Terms of Use ("Terms") govern your access to and use of the Wishfinity website, mobile applications, and related services (collectively, the "Service"), which are operated by EGGTOOTH LLC ("Wishfinity," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Wishfinity. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.
By using the Service, you represent that:
- you are legally permitted to use the Service;
- the information you provide is accurate and current; and
- you have not previously been suspended or removed from the Service for violating these Terms or applicable law.
2. Description of the Service
Wishfinity is a social wishlist, gifting-discovery, and retailer-discovery platform. The Service allows users to create profiles, save wishes, organize lists, follow retailers, connect with other users, receive reminders and notifications, and share public-facing wishlist content.
Wishfinity may also feature:
- retailer pages and product links;
- recommendation or editorial discovery surfaces;
- affiliate links or monetized outbound retailer links; and
- retailer, influencer, or recommendation-oriented public account pages.
Wishfinity is not a marketplace, merchant of record, shipping service, bank, wallet, payment processor, or escrow service.
Wishfinity does not:
- sell or fulfill products directly;
- process payments or hold user funds;
- provide wallet balances, payouts, or cash-gift transfers; or
- guarantee product availability, pricing, descriptions, delivery, or merchant behavior.
Any purchase or transaction related to a product linked through the Service is solely between you and the applicable third-party retailer, seller, or provider.
3. Accounts and Authentication
Some features require an account.
Wishfinity currently supports account access through:
- email magic-link sign-in;
- Google Sign-In; and
- Sign in with Apple.
You are responsible for maintaining the security of your account and for activities that occur under your credentials or device sessions. If you believe your account has been compromised, contact us promptly.
4. Public Nature of the Service
Wishfinity is a social platform. Certain profile and wishlist information is public by design.
By using the Service, you understand and agree that:
- your username and public profile page may be publicly accessible;
- your first name, profile image, and public wishlist content may be visible to others;
- some social, recommendation, retailer, or wishlist activity may be visible within the product; and
- public content may be indexed by search engines, cached, copied, shared, or republished by others.
Wishfinity does not provide an account-level hidden-profile setting.
Some content within the Service may have more limited visibility depending on product settings, but you should only post or save content you are comfortable having associated with your account.
5. User Content
You retain ownership of content you submit to the Service, including text, images, profile information, wish content, list content, and other materials ("User Content").
You grant Wishfinity a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, display, publish, distribute, and otherwise use your User Content as reasonably necessary to operate, maintain, improve, promote, and provide the Service.
You represent and warrant that:
- you own or have the necessary rights to submit the content;
- your content does not infringe, misappropriate, or violate the rights of any third party; and
- your content complies with these Terms and applicable law.
6. Acceptable Use
You agree not to use the Service to:
- violate any law or regulation;
- impersonate any person or entity or misrepresent your affiliation;
- harass, stalk, threaten, abuse, defame, or harm another person;
- upload or share fraudulent, unlawful, infringing, sexually explicit, hateful, or otherwise objectionable content;
- interfere with, disrupt, or degrade the Service or its infrastructure;
- scrape, spider, or systematically extract Service data except as allowed by law or our written permission;
- attempt to bypass security measures, authentication systems, or rate limits;
- upload malware, malicious code, or harmful files;
- mislead users about products, retailers, availability, pricing, gifting intent, or identity; or
- use the Service in connection with fraud, spam, or deceptive commercial practices.
We may remove content, restrict visibility, suspend accounts, or terminate access if we believe use of the Service violates these Terms or creates risk for Wishfinity, users, or third parties.
7. Retailers, Recommendations, and Affiliate Links
The Service may display or link to products, retailers, recommendations, editorial selections, retailer pages, influencer pages, or other third-party content.
Wishfinity may participate in affiliate advertising or referral programs and may earn commissions or fees from qualifying clicks or purchases.
You acknowledge that:
- third-party products and retailer content may change without notice;
- pricing, availability, and descriptions may be inaccurate, incomplete, or outdated;
- Wishfinity does not control or endorse all third-party content; and
- any dealings with advertisers, retailers, influencers, or third parties are solely between you and that third party.
Wishfinity is not responsible for third-party websites, products, transactions, returns, warranties, delivery, or customer service.
8. Notifications and Communications
Wishfinity may send service-related communications, including:
- sign-in and account-access messages;
- security and technical notices;
- support responses;
- product or feature notices;
- push notifications;
- connection requests and social activity alerts;
- wish-related activity alerts; and
- gift-list reminder notifications.
You may be able to control some notification settings in the Service or through your device settings. We may still send transactional or service-related messages even if you opt out of marketing communications.
9. Account Deletion
You may delete your account through the self-service deletion flow in the app settings.
When an account is deleted, Wishfinity may:
- invalidate active sessions and access tokens;
- remove or de-identify certain personal account information;
- preserve certain data, logs, or records for legal compliance, fraud prevention, security, backup, dispute resolution, operational integrity, or legitimate business purposes; and
- make the deleted username available for reuse.
Because of the social and technical nature of the Service, some content, references, logs, cached copies, or reposted material may continue to exist for some time or in limited form after deletion.
10. Suspension and Termination
We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if:
- you violate these Terms;
- we are required to do so by law or legal process;
- your use creates legal, security, abuse, fraud, or operational risk;
- the Service or part of it is modified or discontinued; or
- we reasonably believe such action is necessary to protect Wishfinity, our users, or third parties.
11. Intellectual Property
The Service, including its software, design, layout, text, graphics, logos, trademarks, trade dress, and other materials, is owned by Wishfinity, EGGTOOTH LLC, or its licensors and is protected by intellectual property and other laws.
Except as expressly permitted, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Service.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISHFINITY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.
We do not warrant that:
- the Service will be uninterrupted, secure, or error-free;
- any content, recommendation, profile, retailer page, or product listing will be accurate or current; or
- the Service will meet your expectations or requirements.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISHFINITY, EGGTOOTH LLC, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:
- ONE HUNDRED U.S. DOLLARS ($100); OR
- THE AMOUNT YOU PAID US, IF ANY, FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless Wishfinity, EGGTOOTH LLC, and their affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- your use of the Service;
- your User Content;
- your violation of these Terms; or
- your violation of any law or third-party right.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice through the Service, by email, or by other reasonable means. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Iowa, without regard to conflict of law principles, except to the extent superseded by applicable federal law.
Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Iowa, and you consent to the jurisdiction and venue of those courts.
